BACKGROUND
Ailes is widely credited with the success of the FOX News channel, Rupert Murdoch's cable news network. Hume, O'Reilly and Hannity/Colmes host three nightly shows on the network and their ratings after 9/11 pushed FOX ahead of CNN—where it has stayed. After having built CNBC, he was passed over when MSNBC was launched in 1995. Ailes also worked for Nixon, Reagan and the first President Bush.

PREMISE OF THE SUIT
CLUBS are persons whose successful media activities influence public opinion or whose organizing and lobbying activities give them influence "behind the scenes," invisible to the public. They wield power because you and your representatives in the Congress chose to view, listen or read what they have to say, or because of the access they gain through large political contributions.
